1. Purpose and scope of application 

These Special Conditions of Contract regulate the conditions under which we provide you with the service offered and the transactions that take place on our website. 

From the moment you contract any of the services offered on our website or purchase any of our products, you acquire the status of Client, and this implies express, full and unreserved acceptance of the conditions governing our relationship.

These Special Conditions of Contract are complemented by the provisions of the Legal Notice, General Terms and Conditions of Use, Privacy Policy and Cookies Policy of Decoforhome, accessible through this website.

2. Applicable rules

Both these conditions and the provision of our services shall be governed and interpreted in accordance with Spanish law, and more specifically, shall be subject to the provisions of Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws, Law 7/1996, of 15 January, on the Regulation of Retail Trade, Law 34/2002, of 11 July, on information society services and electronic commerce.

Our products and services comply with the provisions of Spanish legislation, therefore, if your address is outside Spanish territory, you may be subject to the mandatory provisions of the legislation of your country of habitual residence. In this case, it is up to you to verify the applicable legislation prior to contracting our services or purchasing our articles, exempting Decoforhome from any responsibility in this respect.

3. Commercial conditions and product descriptions

The information we offer on commercial conditions through the website is presumed to be accurate and in force as long as it is published on the website. However, exceptionally, there may be a typographical or similar error beyond our control. In the event that the error was a determining factor in the purchase of the product, you may cancel the purchase transaction free of charge.

The contents, descriptions and services offered on the website are provided in Spanish, however, given that Decoforhome makes every effort to ensure the general understanding of the same by its users, it offers a courtesy translation in other languages. These translations are not official translations and Decoforhome cannot guarantee their accuracy and accepts no liability for any errors that may arise from misinterpretations caused by translation, without prejudice to the possibility of offering you an official and comprehensive translation of our content in the future.

Decoforhome may modify the commercial offers on the website at any time, both in terms of products and in terms of prices, promotions and commercial conditions.

The products offered, their characteristics and prices will be those detailed on the screen as the case may be. The prices offered will include VAT, which will be specified during the purchase process. In relation to shipping costs, will be as provided in the section on shipping costs.

From Decoforhome we try to offer images as close as possible to reality, however, we cannot guarantee total accuracy between the product supplied and the graphic representation of the same in the images included on the website, especially in relation to the colour tone or in the case of renewal of the manufacturer's range, with the external appearance of the product or the presentation of the same. We also point out that the products supplied may undergo colour variations between different dye baths, especially in the case of different production batches of the product. 

Consequently, Decoforhome will not assume any responsibility for the difference between the articles supplied and the graphic representation of the same in the images included on the website. 

Types of products that can be purchased through the platform

The products we offer on the platform are divided into two categories:

Standard or retail product: This category of product may be available in stock or on order. Those products that are not in stock at the time of purchase can be ordered through the platform and will be made to order. 

It is important that you know that when you purchase standard or retail products out of stock and you have placed an order for the manufacture of the same, you acknowledge and assume that during the period of manufacture and delivery of such products you may not exercise your right of withdrawal, nor after delivery of the same.

Tailor-made products: This category of products is manufactured according to customer specifications or customised (e.g. customised fabrics, wallpapers, murals, etc.).

Items may be purchased individually or in batches, depending on the characteristics of the item purchased. In cases where items are purchased in batches, the status of the product will be that of the complete batch.

Product samples

Decoforhome offers the possibility of acquiring samples of certain products in order to know precisely the details of the product to be purchased. 

For this purpose, we send up to three free samples, provided they are provided by our supplier, in order to be able to check colours and textures.

You should request them by email, indicating the complete reference of the paper you wish to receive a sample or photo together with your name, surname, address and contact telephone number, and we will then confirm whether it is possible to send them.

The product samples are for guidance only, as the colour of the product may vary from the colour of the samples supplied, taking into account the possibility of changes in the production batch. In this sense, Decoforhome will not be held responsible for any colour variations that may exist between the samples and the products supplied.

4. Purchasing process through the website

The procedures for the purchase of products through the website are those set out in these Special Conditions of Contract, and where appropriate, those indicated on the portal during navigation. 

To place an order for the products offered through the website, you must register as a User, following the instructions that appear on the screen or have a password beforehand. 

The information provided during the registration process must be accurate, truthful and current. You as the Client shall be solely responsible for the consequences of providing inaccurate, inaccurate and out-of-date information. Likewise, you will be solely responsible for any direct or indirect damage or harm that may be caused to Decoforhome as the party responsible for this website or to third parties, if you fill in the data forms with false information or information from third parties causing deception, damage or harm. If Decoforhome finds or has sufficient evidence that the information provided does not meet the requirements, it may, at any time, cancel your account.

Once you have completed the registration process on the website, you must follow the instructions that appear on the electronic form that Decoforhome makes available to you to process the order. This form will be sent to Decoforhome to formalise the purchase. 

Within a maximum period of 24 hours from the completion of the purchase, you will receive an e-mail in the account provided for this purpose, confirming the purchase made and the details of the order. If you notice any errors in the confirmation details or disagree with them, you should contact Decoforhome and ask for the details to be corrected or the order to be cancelled. 

The purchase confirmation and order details do not have the status of an invoice, in any case the invoice will be sent to you upon delivery of the goods or will be available in your customer account.

As Decoforhome cannot guarantee the stock of the products ordered at all times, orders will be dealt with in strict order of request.

5. Payment of the product

Payment for products purchased through the website will be made by the following means of payment at the time of purchase:

- Bank card

- Bizum

- Scalapay

- Google Pay

- Apple Pay

- Paypal

- Bank transfer

To make the payment through each of the above payment methods, you must follow the instructions that appear on the screen and pay the amount of the purchase.

We guarantee that every transaction carried out on Decoforhome is 100% secure. All transactions involving the transmission of personal or bank details are carried out using a secure environment. Decoforhome uses a server based on standard SSL (Secure Socket Layer) security technology. All the information you transmit to us travels encrypted through the network (if you want to know more, visit our Secure Payment section).

Likewise, your credit card details are not recorded in any database, but go directly to the Bank's POS (Point of Sale Terminal).

We would also like to inform you that in an effort to provide greater security to credit card owners, we have incorporated the secure payment system called CES (Secure Electronic Commerce) into our payment gateway. In this way, if you are a holder of a "secured" card, you will always be able to make payments with a VISA or MASTERCARD in our shop.

In the event that your card is not a member of this payment system, Decoforhome will only accept payment by VISA or MASTERCARD credit card for customers with a proven track record and reliability.

In both cases, when paying by VISA or MASTERCARD, the following information will always be requested: the card number, the expiry date, and a Validation Code that matches the last 3 digits of the number printed in italics on the back of your VISA or MASTERCARD, thus offering more guarantees about the security of the transaction.

Important : Credit card fraud is a crime and Decoforhome will take legal action against anyone who makes a fraudulent transaction in our online shop.

6. Shipping costs

The prices of the products offered on the website do not include shipping costs. These costs vary depending on your place of residence and the offers and promotions that may exist at any given time. In any case, those that appear on the screen during the purchase process will be applicable.

Deliveries made to regions outside the European Customs Union, the recipient of the goods will be responsible for paying the import duties at destination.

All orders can be delivered and invoiced in parts. Subsequent deliveries made for the same order may be subject to shipping costs, in any case the information will appear on the purchase screen. Decoforhome will offer you the possibility of choosing between waiting for the entire order to be completed or the possibility of receiving partial deliveries.

7. Delivery times

The maximum expected delivery time for standard or retail products will be 15 working days, as long as we have stock. In the event that the product purchased is not in stock or is a made-to-measure product, the delivery times will be conditioned by the manufacturing times. Products that require different delivery times will reflect this particularity in their description.

In the event that the chosen product is not available, Decoforhome will contact you and, if possible, provide you with an indicative delivery date. If it is not possible to deliver the purchased product, Decoforhome will offer you the possibility to cancel the purchase or purchase a product with similar characteristics.

As a customer, you must provide Decoforhome with the delivery address. The delivery will be made by a courier service. If, at the time of delivery, you detect any disagreement with the delivered product, you must indicate this in writing on the delivery note and contact Decoforhome immediately at info@decoforhome.com.

Decoforhome will not be held responsible for any errors made when providing the delivery address or for the absence of the recipient at the aforementioned address. 

8. Withdrawal

Consult our cancellation policy in our Shipping and Returns Policy.

9. Intellectual Property

The intellectual property rights of the products offered through the website belong to Decoforhome or third parties. As a Client, you do not acquire any rights over these rights and the reproduction, transformation, public communication and/or dissemination of the products supplied through the website is prohibited.

Any infringement of intellectual and industrial property rights, except with the express and unequivocal consent of the legitimate owner, may be reported and legally prosecuted.

10. Assignment of the contract

As a Client, you may not assign your contractual position and the rights and obligations arising from the purchase of products through the website to third parties without the express consent of Decoforhome.

Decoforhome may assign to third parties its legal position in this contract to another company that may market the product offered through the website by notifying you in advance.

11. Termination

The following shall be causes for termination of the contract, in addition to those provided for by law:

- Mutual agreement of the parties.

- Extinction of the legal personality and/or death of one of the parties or judicial declaration of bankruptcy of creditors of any of the parties.

- Failure to pay the agreed price, including taxes, or the delivery or return costs.

- Failure by the Client to comply with these Particular Conditions of Contract or those set out in the Legal Notice, Conditions of Use, Privacy Policy.

12. Communications and notifications

All notifications that Decoforhome must send will be sent to the e-mail address provided when filling in the purchase form, or alternatively to the address provided.

13. Integrity of the contract

In the event that any of the present clauses should be declared totally or partially null and void or ineffective, such nullity or ineffectiveness shall only affect that provision or the part of the same that is null and void or ineffective, and the present contracting conditions shall subsist in all other respects, with such provision, or the part of the same that is affected, being deemed not to have been included. 

These terms and conditions, as well as the prices, articles and offers may be modified at any time and without prior notice by Decoforhome. The aforementioned modifications will be published on the website for your information, and will come into effect from the moment of their publication. The modifications made will not have retroactive effects on those acquisitions that were carried out prior to the publication of said modification.

14. Applicable law and jurisdiction

This contract is subject to Spanish law.

In the event of any dispute arising regarding the interpretation or application of these terms and conditions of contract, the same shall be submitted to the Courts and Tribunals established by the applicable legislation. In the case of end consumers, the place of fulfilment of the obligation or the place of domicile of the purchasing party shall be taken into account. In the event that you are domiciled outside Spain or are a professional, the dispute will be resolved, expressly waiving any other jurisdiction that may be applicable, in the Courts and Tribunals of A Coruña (Spain).
